ORDINANCE 840
AN ORDINANCE PERTAINING TO WATER RATES AND AMEND ARTICLE 15 SECTION 111 AND REPEAL ANY CONFLICTING ORDINANCES.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FLORENCE:
SECTION 3. Article 15 Section 111 is hereby amended to read as follows:
15-111 WATER RATES. The following water rates are hereby established for all consumers of water within the city limits of City of Florence, Kansas:
a. A minimum of 2,000 gallons or less $29.90
b. Each additional 1,000 gallons over 2,000 gallons $18.77
c. Additional charge: In addition to the water rates set out above, the City of Florence shall collect the sum of 0.01876944 for 1,000 gallons or any part of 1,000 gallons of water used. Such rates shall be determined, collected, and paid in the same manner as the rates for City water use are otherwise established.
d. The governing body shall conduct an annual review of the financial condition of the City’s water utility on or before January 31st of each year in order to evaluate the need for any adjustment to the current water charges. Such review shall be held during a council meeting open to the public. If, on or before January 31 each year, the governing body takes action to adjust the current water charges, such adjustment shall go into effect for any charges yet to be billed to customers. If the governing body takes no action on or before January 31 of each year, the current water charges shall be increased by 3% effective for any charges yet to be billed to customers. After its annual review, the governing body may, by motion made and adopted at a city council meeting, announce its intention that charges shall remain the same for the following year and such a motion shall be considered action which negates the automatic percentage increase set out herein for the following year
SECTION 4. REPEAL. Article 15 Section 111 and all other ordinances and sections in conflict herewith are hereby repealed.
SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its publication in the official city newspaper.

GENERAL NOTICE
TO CONTROL NOXIOUS WEEDS
The Kansas Noxious Weed Law K.S.A. 2-1314 et seq requires all person who own or supervise land in Kansas to control and eradicate all weeds declared noxious by legislative action. The weeds declared noxious are Field Bindweed, Musk Thistle, Johnsongrass, Bur Ragweed, Canada Thistle, Sericea Lespedeza, Leafy Spurge, Hoary Cress, Quackgrass, Russian Knapweed, Kudzu, and Pignut. Notice is hereby given pursuant to the Kansas Noxious Weed Law to every person who owns or supervises land in Marion County that noxious weed growing or found on such land shall be controlled and eradicated. Control is defined as preventing the production of viable seed and vegetative spread of the plant.
Failure to observe this notice may result in the County:
1. Serving legal notice requiring control of the noxious weeds within a minimum of five days. Failure to control the noxious weeds within the time period allowed may result in the county treating the noxious weeds at the landowners expense and placing a lien on the property if the bill is not paid within 30 days or,
2. Filing criminal charges for non-compliance. Conviction for non-compliance may result in a fine of $100 per day of non-compliance with a maximum fine of $1,500.
The public is also hereby notified that it is a violation of the Kansas Noxious Weed Law to barter, sell or give away infested nursery stock or livestock feed unless the feed is fed on the farm were grown or sold to a commercial processor that will destroy the viability of the noxious weed seed. Custom harvesting machines must be labeled with a label provided by the Kansas Department of Agriculture and must be free of all weed seeds and litter when entering the State and when leaving a field infested with noxious weeds. Additional information may be obtained from the County Noxious Weed Department or by contacting the Kansas Department of Agriculture, 1320 Research Park Drive, Manhattan, KS 66502.
The Marion County Noxious Weed Department has the chemicals on hand that are needed to treat noxious weed problems.
The chemicals we currently have on hand are as follows:

ORDINANCE NO. 841
AN ORDINANCE PERTAINING TO ARTICLE 9 SECTIONS 16-904 AND 16-905 SEWER RATES AND PENALTIES AND REPEALING OF CONFLICTING ORDINANCES.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FLORENCE:
SECTION 9 16-904 The following monthly charges shall be made by the City on the gallons of water metered per month:
(a) 0-9,999 gallons of water $ 28.22
(b) 10,000 – 19,999 gallons of water $ 55.37
(c) 20,000 – 49,999 gallons of water $ 71.06
(d) 50,000 – 74,999 gallons of water $ 90.93
(e) 75,000 – 99,000 gallons of water $ 112.09
(f) 100,000 gallons of water and over $ 0.017252666

SECTION 9 16-905 Collections and Charges
All fees and charges provided for by this article shall be collected by the City Clerk of the City of Florence along with any other utilities which are provided by the City of Florence. If such fees and charges are not paid on or before the fifteenth day of each month, then in that event the City shall discontinue water service after the provisions contained in Section 16-901 are complied with and in addition thereto the Clerk shall assess a fifteen percent (15%) delinquent charge if said sum is not paid by the 15th day of the month.
Provided, however, that the owner of a unit certifies that said unit was not occupied during any full month, and providing that there was no water metered during the same period of time, said unit is not subject to the sewer charge, and the City Clerk may deduct it from the total charges.
SECTION 7. REPEAL. Article 9 Section 16-904 and 16-905 and all other ordinances and sections in conflict herewith are hereby repealed.
SECTION 8. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its publication in the official city newspaper.
